3. In the Matter of Nelson E. Oliva, FPPC No. 11/863 (Default Decision). Staff: Commission Counsel Milad Dalju and Special Investigator Annaraine Diaz. In this matter, Respondent, Nelson E. Oliva, the City Manager of the City of Hercules from April 1, 2007, through January 9, 2011, failed to report gifts he received from NEO Consulting Inc., dba Affordable Housing Solutions Group (“NEO”), in 2007, 2008, 2009, and 2010, totaling $234,775.96 in value, in violation of Government Code Sections 87200, 87203, and 87204 (1 count), accepted gifts from NEO in 2008, 2009, and 2010, in excess of the respective annual gift limit of $390, $420, and $420, in violation of Government Code Section 89503, subdivision (a) (1 count), and, in his capacity as City Manager of the City of Hercules, made, participated in making, or attempted to influence 16 governmental decisions in which he knew, or had reason to know, he had a disqualifying financial interest, by awarding 16 city contracts, totaling $2,889,000, to NEO, in violation of Government Code Section 87100 (12 counts). Total Proposed Penalty: $70,000.

4. In the Matter of Dean Florez, Dean Florez for Lt. Governor 2010, and Dean Florez for State Controller 2014, FPPC No. 12/213. Staff: Commission Counsel Milad Dalju and Program Specialist Grant Beauchamp. Respondent, Dean Florez (Respondent Florez), was a candidate for Lt. Governor in 2010, is a candidate for State Controller in 2014, and previously served as an assembly member and a senator. Respondent Florez and his candidate controlled committee, Dean Florez for Lt. Governor 2010, made 3 expenditures, totaling $6,434.42, that were not related to a political, legislative or governmental purpose, in violation of Government Code Sections 89512 and 89513 (2 counts); and failed to refund approximately $247,000 in general election contributions in violation of Government Code Section 85318 (1 count). Respondent Florez and his candidate controlled committee, Dean Florez for State Controller 2014, made 166 expenditures, totaling $20,107.47, that were unrelated to a political, legislative or governmental purpose, in violation of Government Code Sections 89512 and 89513 (9 counts). Total Proposed Penalty: $60,000.

5. In the Matter of Robert L. Griffith and Committee To Elect Robert Griffith, FPPC No. 12/344 (Default Decision). Staff: Senior Commission Counsel Angela Brereton. In this matter, Respondent, Robert L. Griffith, is an elected governing board member of the Mountain View School District, who has served since 1989 and is currently running for re-election for his seventh four-year term. Respondent, Committee To Elect Robert Griffith, is Respondent Griffith’s controlled committee. In this matter, Respondents failed to file eight semi-annual campaign statements, in violation of Government Code Section 84200, subdivision (a) (8 counts); and failed to file two pre-election campaign statements in violation of Government Code Sections 84200.5 subdivision (c) and 84200.8, subdivision (a) (2 counts). Additionally, Respondent Griffith failed to file his 2011 Annual Statement of Economic Interests in violation of Government Code Section 87203 (1 count). Respondents ignored numerous notifications from filing officers and the Enforcement Division in this regard and have an extensive history of the same violations of the Act. Additionally, Respondent Griffith in still in office and is running for re-election to his seventh four-year term. Therefore, the maximum penalty is recommended for these eleven counts. Total Proposed Penalty: $55,000.

6. In the Matter of California Association of Highway Patrolmen and Jon H. Hamm, FPPC No. 12/724. Staff: Commission Counsel IV Galena West and Program Specialist Luz Bonetti. Respondent, California Association of Highway Patrolmen, is a general purpose committee sponsored by the California Association of Highway Patrolmen and Respondent, Jon H. Hamm, served as Treasurer. This case arose from a Franchise Tax Board audit for the period January 1, 2009, through December 31, 2010. In this matter, Respondents failed to timely file a preelection campaign statement, in violation of Government Code Sections 84200.5, subdivision (d), and 84200.7 (1 count); failed to timely disclose the accurate balance of cash for ten consecutive reporting periods beginning January 1, 2009, through December 31. 2010, by up to approximately $98,459, in violation of Government Code Section 84211, subdivision (e) (1 count); and failed to timely report contributions received during four consecutive reporting periods beginning May 23, 2010, through December 31, 2010, totaling approximately $151,239, in violation of Government Code Section 84211, subdivisions (a) and (d) (1 count). Total Proposed Penalty: $6,500.

7. In the Matter of Isaac Galvan, Galvan for Compton City Council 2013, and Isaac Galvan, Treasurer, FPPC No. 13/748. Staff: Political Reform Consultant Adrianne Korchmaros. Respondents, Isaac Galvan, Galvan for Compton City Council 2013, and Isaac Galvan, as Treasurer, failed to timely file the Candidate Intention Statement (Form 501), the Candidate Statement of Economic Interests (Form 700), two pre-election campaign statements covering the period January 1, 2013, through May 18, 2013, due on April 25, 2013 and May 23, 2013, as well as the semi-annual campaign statement covering the period May 19, 2013, through June 30, 2013, due on July 31, 2013, with the City of Compton in violation of Government Code Sections 84200, 84200.5, 85200, and 87201 (5 counts). Total Proposed Penalty: $1,000.

Respondent, Ernie Morrison, is a sitting member on the Oxnard School District Board of Trustees. Respondents, Ernie Morrison, the Committee to Elect Ernie “Mo” Morrison Governing Board Member 2010, and Assistant Treasurer, Sue Odgers, failed to timely file four semi-annual campaign statements after the election, covering January 1, 2011 through December 31, 2012, in violation of Government Code Section 84200 (4 counts). 13. In the Matter of Tim Do AKA Thinh Thien Do, individually, and DBA Catering Food Supply, FPPC No. 10/740. Staff: Senior Commission Counsel Neal Bucknell, Special Investigator Beatrice Moore, and Law Clerk Kyle Levy. On or about December 31, 2009, Respondent made a contribution in the amount of $5,000 to the committee known as McCarty for Assembly 2010, but the true source of the contribution was concealed. This was accomplished by making the contribution in the names of intermediaries, thereby creating the false appearance that Respondent was not the true source of funds—when in fact, Respondent was the true source of funds. In this way, Respondent violated Government Code Section 84301, which prohibits campaign money laundering (1 count). Total Proposed Penalty: $5,000.

Respondent, Mike Roos, was a registered lobbyist and Founder and Chief Consultant of Mike Roos and Company, a registered lobbying firm located in Los Angeles. Respondent made prohibited contributions to committees controlled by two elected state officers and a candidate for elected state office while registered to lobby the California State Legislature and Governor, in violation of Government Code Section 85702 (1 count). 113. In the Matter of Voters for a New California and Joaquin Ross, FPPC No. 10/470. Staff: Senior Commission Counsel Neal Bucknell and Special Investigator Paul Rasey. On April 25, 2013, the Commission approved a Stipulation, Decision and Order in this case, which imposed a penalty in the amount of $6,500 against Respondents Voters for a New California and Joaquin Ross for making an over-the-limit non-monetary contribution in support of Luis Alejo’s candidacy for the California State Assembly (and for falsely reporting the contribution as an independent expenditure). Thereafter, the Enforcement Division notified Assemblyman Alejo of his duty to “disgorge” the over-the-limit portion of the contribution from Voters for a New California by making payment to Voters for a New California in the amount of $21,092 (which was the amount in excess of the contribution limit of $3,900 per election). On October 4, 2013, the Enforcement Division received proof of payment in this regard from Assemblyman Alejo.
