1. Public Comment for Items not on Agenda. During this comment period, any person is invited to speak on any topic that is not listed on this agenda. Action may not be taken on any matter raised during this public comment period until the matter is specifically listed on a future agenda. Those who wish to comment on an item that has been listed on this agenda may comment when that item has been opened for consideration by the Commission and before any action is taken.
The Commission should avoid discussing and may not act on any matter raised during this public comment period, except to decide whether to place the matter on the agenda of a future meeting during the last item on the agenda.

3-6. Consent Calendar
Items on the consent calendar will be taken up and voted on as a group. A Commissioner may request that an item be removed from consent, in which case it will be discussed separately in the meeting.
Laundered Campaign Contributions
3. In the Matter of Dougles Treisman and Treisman for Judge 2020; FPPC No. 22/714. Staff: Marissa Corona, Senior Commission Counsel. This matter arose from an audit performed by the Franchise Tax Board’s Political Reform Audit Program. Douglas Treisman was an unsuccessful candidate for Fresno County Superior Court Judge in the March 3, 2020 Primary Election. Treisman for Judge 2020 was Treisman’s candidate-controlled committee. The Committee and Treisman caused Treisman's father to make a campaign contribution in the name of another, in violation of Government Code Section 84301 (1 count). Total Proposed Penalty: $4,500.
Mass Mailings at Public Expense
4. In the Matter of City of Hanford; FPPC No. 22/564. Staff: Alex Rose, Senior Commission Counsel and Alethea Perez, Special Investigator. The respondent was represented by Ty Mizote of Griswold LaSalle. The City of Hanford sent prohibited campaign-related mass mailings at public expense, in violation of Government Code Section 89001 and Regulation 18901.1 (1 count); failed to include the proper advertising disclosure on mailers, in violation of Government Code Sections 84502 and 84504.2 (1 count); failed to timely file an independent expenditure committee campaign statement for the period ending June 30, 2022, in violation of Government Code Section 84200, subdivision (b) (1 count); and failed to timely file one 24-Hour Report, in violation of Government Code Section 84204 (1 count). Total Proposed Penalty: $18,000.

5. In the Matter of California Voter Project; FPPC No. 19/1386. Staff: Theresa Gilbertson, Senior Commission Counsel and Alethea Perez, Special Investigator. California Voter Project was a general purpose committee. The Committee failed to timely file two 24-Hour Reports, in violation of Government Code Sections 84203 and 84204 (1 count). Further, the Committee failed to timely file a semiannual campaign statement, in violation of Government Code Section 84200 (1 count.) Total Proposed Penalty: $6,500.

6. In the Matter of Michael Minnix and Committee to Re-Elect Michael Minnix; FPPC Nos. 20/817 & 20/998. Staff: Laura Columbel, Commission Counsel and Alethea Perez, Special Investigator. Michael Minnix was a successful candidate in the November 3, 2020 General Election. Committee to Re-Elect Michael Minnix was Minnix’s candidate-controlled committee. Minnix failed to timely file a Statement of Intention, in violation of Government Code Section 85200 (1 count). The Committee and Minnix failed to timely file a Statement of Organization, in violation of Government Code Section 84101 (1 count); six 24-Hour Reports, in violation of Government Code Section 84203 (6 counts); one pre-election campaign statement, in violation of Government Code Section 84200.5 (1 count); and seven semiannual campaign statements, in violation of Government Code Section 84200 (4 counts). The Committee and Minnix also failed to include the proper disclosures on two mass mailings, in violation of Government Code Section 84305 (1 count). Total Proposed Penalty: $41,000.

7. Pre-Notice Discussion of Proposed Amendments to Regulation 18536, Transfer and Attribution of Contributions. Staff: Erika M. Boyd, Senior Commission Counsel. Staff presents proposed amendments to Regulations 18536, instituting a requirement for a committee receiving transferred contributions subject to attribution to notify contributors of the transfer. The proposed amendments are presented for pre-notice discussion and feedback, with potential adoption to occur at the November Commission meeting.

8. Adoption of Amendments to Regulation 18351, FPPC Conflict of Interest Code. Staff: Lindsay Rice, Manager Email Advice and Conflict of Interest Code Program, Legal Division. Staff proposes to amend Regulation 18351 to update the positions, disclosure categories and other provisions in the Commission’s conflict of interest code. The proposed amendments are submitted for adoption by the Commission.

9. The FPPC Streamline Program: How It Works (Part 1). Staff: Theresa Gilbertson, Senior Commission Counsel, Enforcement Division and Jonathan Rivera, Commission Counsel, Enforcement Division. Introduction to the Streamline Program, including a history of the Streamline regulations and a summary of the Streamline procedures.
10. Legislative Update. Staff: Lindsey Nakano, Senior FPPC Legislative Counsel. The Commission will review and discuss potential sponsored and other legislation. The Commission may provide direction to staff regarding the same.
11. Appointment of Vice Chair. The Commission will appoint a Vice Chair to preside over Commission meetings in the Chair’s absence in accordance with the Commission Governance Policy.
12. Appointment of Law and Policy Committee Member. The Commission will appoint a new member to join the Law and Policy Committee alongside the Chair.
